What Qualifies as a Substantial Change in Circumstances

Florida courts don’t grant modifications simply because one party is unhappy with an existing order. The law requires that the change in circumstances be substantial, material, involuntary, and permanent before a court will consider modifying child support or alimony. For parenting plan and time-sharing changes, Florida Statute section 61.13(3) requires both that threshold showing and a judicial finding that the modification serves the child’s best interests.

Common triggers that may meet this standard include:

• Significant income change: A major job loss, reduction in earnings, or substantial increase in income for either party
• Serious illness or disability: A medical condition affecting a party’s ability to earn income or care for a child
• Relocation: A parent’s move that materially affects the existing time-sharing schedule
• Remarriage or cohabitation: An alimony recipient entering a supportive relationship as defined under Florida Statute section 61.14
• Changes in a child’s needs: Increased medical, therapeutic, or educational expenses not anticipated in the original order
• Parenting plan violations: A pattern of one parent failing to follow the existing order
• Anticipated retirement: An obligor may file a petition up to six months before retirement takes effect under Florida Statute section 61.14

A voluntary decision to reduce income, such as leaving employment to lower a support obligation, generally won’t support a modification petition. Timing also matters: a modification order may relate back to the date the supplemental petition is filed, not the date the court enters the new order. Delaying the filing can forfeit retroactive relief the facts might otherwise support.

The Modification Process in Palm Beach County

Modification cases in West Palm Beach are heard by the Palm Beach County Family Division of the 15th Judicial Circuit Court. Before any petition is filed, we assess whether your facts meet Florida’s legal threshold. Filing a petition that doesn’t clear that bar wastes time and resources, so the evaluation step isn’t optional.

Once we determine the circumstances support a modification, the process generally follows one of two tracks:

• Agreed modification: Both parties negotiate terms, reach an agreement, and submit an agreed order to the Palm Beach County Family Division for judicial approval. Straightforward agreed modifications may be completed in a matter of months, though timelines depend on the court’s schedule and the complexity of the facts.
• Contested modification: When parties can’t reach an agreement, we prepare and file a contested petition and represent you at evidentiary hearings before the court. Contested cases that proceed to a hearing can take considerably longer depending on scheduling and the scope of the dispute.

Both tracks require documentation. Depending on the type of modification, that may include recent pay stubs, tax returns, records of new or increased expenses, medical documentation, or evidence of parenting plan violations. Modification petitions must be filed in the circuit where either party resides or where the original order was entered, consistent with Florida Statute section 61.14.

Standards by Order Type: Custody, Support & Alimony

Each category of modification carries its own legal standard under Florida law. Understanding those differences helps set realistic expectations before a petition is filed.

Child Custody & Time-Sharing

A parenting plan modification requires proof of a substantial and material change in circumstances and a court finding that the proposed change is in the child’s best interests. Florida courts don’t modify time-sharing arrangements because one parent prefers a different schedule. The burden rests on the party seeking the change.

Child Support

Florida’s child support guidelines provide a formula for recalculating support based on current income and expenses. A modification may be warranted when the recalculated amount differs from the existing order by at least 15 percent or $50, whichever is greater. Either an increase or a decrease in income for either party can trigger a recalculation.

Alimony

Under Florida Statute section 61.14, alimony may be modified or terminated when there is a substantial change in the financial circumstances of either party. Bridge-the-gap alimony can’t be modified once awarded. Rehabilitative and durational alimony may each be modified upon the required showing. For clients with permanent alimony orders entered before July 1, 2023, those awards remain in effect and are subject to modification under the applicable statute. Permanent alimony is no longer available in cases governed by Florida’s 2023 alimony reform. Alimony may also be reduced or terminated if the recipient has entered into a supportive relationship as defined by statute. One important limit: if alimony wasn’t awarded in the original divorce, it can’t be added later through a modification petition.
