Palm Beach Marital Agreements Lawyer
While most people hope for a lasting marriage, the sad reality is that divorce is common. While you can't prevent divorce, you can take steps to protect your property and your children through the use of a marital agreement. A marital agreement is a legal document that defines the rights and obligations of each spouse in the event of a divorce. It can also address other issues, such as how the couple will handle parenting and support matters, or how they will divide their property.
If you are considering a marital agreement, you should seek the counsel of an attorney with experience in marital agreements. At John F. Schutz, P.L., our Palm Beach marital agreements attorney can review your situation and help you determine the best course of action. We can draft a marital agreement for you or represent you in the negotiation of an existing marital agreement.
Drafting a Marital Agreement in Florida
There are no specific rules or requirements for drafting a marital agreement. The agreement can be drafted by either spouse or by an attorney on behalf of either spouse. The agreement can be very simple or very complex, depending on the circumstances and desires of the spouses.
Marital agreements are useful in many different situations. Some of these include:
- To protect separate property
- To protect the spouse who earns less income from having to pay marital debts and obligations
- To define child custody and support matters in the event of a divorce
- To plan for the division of property and debts, including the division of real property
- To plan for the distribution of assets and debts if one spouse dies

"Genius divorce lawyer"
John Schutz is a brilliant lawyer. Not only did Mr. Schutz do an excellent job cleaning up the mess from the previous lawyer, he in my estimation was key in me ultimately obtaining a very good outcome. I had a very contentious divorce and the opposing lawyer was very unprofessional and somewhat abusive. Mr. Schutz through his professionalism and excellent people skills was able to reign in the opposing attorney's unprofessional conduct. Mr. Schutz ran circles around the opposing attorney as he was always prepared and was quick on his feet. He is well worth the money in my opinion. Due to his skill and the ability to outclass the opposing attorney, a trial was avoided which ultimately would have been far more costly. Highly recommend.- Elizabeth
