Filing for Divorce in Florida as a Military Member

Florida requires at least one spouse to have resided in the state for six months before filing for divorce. For active-duty service members stationed in Florida, military orders may be accepted as evidence supporting the residency requirement. That distinction matters for service members who have only recently been posted to the state.

Active-duty members generally have multiple venue options: the state where they live, where they’re stationed, or where they hold legal residency. The choice of venue affects which state’s laws govern child support, alimony, and other matters. Where a couple was married has no bearing on where they must file in Florida. Cases filed in Palm Beach County are handled by the 15th Judicial Circuit Court.

The Servicemembers Civil Relief Act & Divorce Proceedings

The Servicemembers Civil Relief Act (SCRA) is a federal law designed to protect active-duty service members whose military duties prevent them from fully participating in court proceedings. Understanding it benefits both the service member and the non-military spouse because it directly affects case timing and strategy.

A service member served with divorce papers may request a stay, meaning a postponement of proceedings, by demonstrating that military duties materially affect their ability to respond. A stay can last for the duration of active service and up to 60 days after service ends. The SCRA also prevents a court from entering a default judgment against a service member without first appointing an attorney to represent their interests. Neither party should move forward without understanding how these protections apply to their specific situation.

Dividing Military Retirement Pay & Benefits in Florida

The Uniformed Services Former Spouses’ Protection Act (USFSPA) authorizes state courts to treat military retirement pay as marital property subject to Florida’s equitable distribution rules. A former spouse’s right to a share of that retirement pay doesn’t depend on how long the marriage overlapped with military service.

What the length of overlap does affect is the payment mechanism. If the parties were married for at least 10 years, overlapping with 10 years of creditable military service, the former spouse may receive direct payment through the Defense Finance and Accounting Service (DFAS). If that 10-year overlap isn’t met, the former spouse may still receive a court-ordered share of retirement pay, but the service member may be responsible for making those payments directly rather than through DFAS. This is the “10/10 rule,” and it governs how payments are made, not whether a share exists.

Other benefit assets in military divorce require separate analysis:

Thrift Savings Plan (TSP): The TSP functions as a retirement savings account for federal employees and service members. The marital portion may be divided by court order as a marital asset, subject to plan-administrator requirements distinct from civilian pension orders.
Survivor Benefit Plan (SBP): The SBP allows a service member to designate a former spouse as a beneficiary for a portion of retirement pay after the service member’s death. Whether to elect SBP coverage is a significant financial decision that shapes the long-term value of the retirement division.

Child Custody & Parenting Plans in Military Divorce

Florida courts decide custody based on the best interests of the child, weighing each parent’s ability to provide stability, the child’s relationship with each parent, and each parent’s realistic availability. Military service doesn’t automatically disqualify a parent from shared custody; courts consider a service member’s demonstrated commitment to the child and the support systems in place.

Temporary custody orders can be entered to address a deployment while preserving the long-term parenting plan once the service member returns. Effective parenting plans for military families typically address electronic communication during deployment, delegation of parenting time to a designated family member during an absence, and procedures for adjusting the schedule around permanent change-of-station orders.

Child support calculations in Florida military cases treat base pay plus allowances such as BAH and BAS as components of income. Modifications may be appropriate when deployment pay, combat pay, or duty-station changes alter the service member’s overall compensation. Building flexibility into the parenting plan from the start can reduce the likelihood of repeated returns to court as circumstances change.
