The Divorce Process & Local Considerations in West Palm Beach

Every divorce in Florida follows specific steps, and the process can look different based on your situation. Here’s what to expect when working with a divorce attorney in West Palm Beach:

  • Filing requirements: At least one spouse must reside in Florida for six months before filing. Most West Palm Beach divorce proceedings take place in the Fifteenth Judicial Circuit Court, which can impact case scheduling and local requirements.
  • No-fault approach: In Florida, most couples state their marriage is "irretrievably broken"—so you usually do not need to prove fault for the court to grant a divorce.
  • Collaborative processes: In Palm Beach County, many families voluntarily use collaborative divorce or mediation to negotiate settlements. These paths often keep legal and personal details private and allow families more flexibility.
  • Court involvement: If you cannot resolve all issues, a judge may decide outstanding concerns about children, finances, or property. As your advocate, we clarify expectations for each step and help you stay informed about what to anticipate in the local court.

Additional Local Procedures & Timeframes

If you have children, Palm Beach County usually requires both parents to attend a parenting course before the divorce is finalized. Families may also participate in mediation as a standard part of the process, allowing everyone to resolve disagreements before a court hearing becomes necessary. Our understanding of these requirements ensures that you prepare fully, with up-to-date information about forms, deadlines, and next steps. By anticipating hurdles, we give you a smoother, more predictable experience during what can be a stressful time.

Hear From Our Happy Clients

"Genius divorce lawyer"

John Schutz is a brilliant lawyer. Not only did Mr. Schutz do an excellent job cleaning up the mess from the previous lawyer, he in my estimation was key in me ultimately obtaining a very good outcome. I had a very contentious divorce and the opposing lawyer was very unprofessional and somewhat abusive. Mr. Schutz through his professionalism and excellent people skills was able to reign in the opposing attorney's unprofessional conduct. Mr. Schutz ran circles around the opposing attorney as he was always prepared and was quick on his feet. He is well worth the money in my opinion. Due to his skill and the ability to outclass the opposing attorney, a trial was avoided which ultimately would have been far more costly. Highly recommend.
