FAQs About Divorce in Palm Beach County

What Is Collaborative Divorce?

Collaborative Divorce is a method designed to handle divorces without litigation. This process involves both parties committing to resolving their disputes outside of court, often with professional assistance from lawyers, financial advisors, and child specialists. This approach is beneficial as it allows for greater flexibility and control over the outcomes. At John F. Schutz, P.L., we specialize in guiding clients through this amicable process, ensuring their interests are properly represented while fostering a cooperative environment. It’s an excellent option for couples looking to avoid the adversarial nature of traditional divorce proceedings, keeping the focus on creating a positive future for both parties. By removing the win-lose scenario, collaborative divorce reduces time, costs, and stress, providing a more dignified path during this life transition.

How Is Child Custody Determined in Palm Beach County?

In Palm Beach County, child custody decisions prioritize the child's best interests. Florida courts encourage shared parental responsibility unless it is determined that it would not be beneficial to the child. Factors considered include each parent’s ability to meet the child’s needs, the child’s home stability, and the moral fitness of the parents. Our firm is adept at developing effective parenting plans that support the child’s welfare post-divorce. John F. Schutz and his team assess each unique family dynamic to advocate for arrangements that align with the children's best interests, ensuring their protection and stability during and after the divorce process. Moreover, we focus on creating detailed parenting plans that facilitate clear communication and cooperation between parents, aiming to maintain continuity and predictability in the child's life.

How Are Divorce Assets Divided in Palm Beach County?

Florida is an equitable distribution state, meaning assets and liabilities are divided fairly, but not necessarily equally, during divorce. The court assesses factors like the duration of the marriage, each spouse's economic circumstances, and contributions to the marriage, including homemaking and childcare. During Collaborative Divorce, we work with financial professionals to ensure a fair assessment and distribution of assets. At John F. Schutz, P.L., our process emphasizes clarity and fairness, striving for resolutions that honor the contributions and needs of each spouse, reducing the potential for ongoing disputes. By employing financial consultants, we provide comprehensive evaluations of all assets, including real estate and investments, ensuring transparency and preparedness in every negotiation.

What Are the Benefits of Collaborative Divorce?

Collaborative Divorce offers several advantages, including reduced emotional strain and cost savings by avoiding prolonged court proceedings. This method fosters communication and cooperation, which can lead to more personalized and satisfactory outcomes. It is specifically designed to protect the privacy and dignity of both parties. We at John F. Schutz, P.L. facilitate a supportive environment where couples can openly discuss their needs and reach amicable agreements, focusing on sustainable, family-friendly solutions. Additionally, this approach helps maintain a sense of control during the divorce process, enabling both parties to have a direct impact on the outcomes and fostering long-term cooperation even after divorce.

Hear From Our Happy Clients

"Genius divorce lawyer"

John Schutz is a brilliant lawyer. Not only did Mr. Schutz do an excellent job cleaning up the mess from the previous lawyer, he in my estimation was key in me ultimately obtaining a very good outcome. I had a very contentious divorce and the opposing lawyer was very unprofessional and somewhat abusive. Mr. Schutz through his professionalism and excellent people skills was able to reign in the opposing attorney's unprofessional conduct. Mr. Schutz ran circles around the opposing attorney as he was always prepared and was quick on his feet. He is well worth the money in my opinion. Due to his skill and the ability to outclass the opposing attorney, a trial was avoided which ultimately would have been far more costly. Highly recommend.
